Terms & conditions: 'Ultimate cricket-lovers' competition

How to enter

To enter, entrants must, during the Promotion Period:

1. Follow @library_vic on Instagram, post a photo of The Ashes Urn from the Velvet, Iron, Ashes exhibition and hashtag #VelvetIronAshes to go in the draw.
2. Accept the competition terms and conditions, confirming that they have read and understood the terms and conditions.

All entrants go into the draw for a chance to win the prize.

You may enter the Competition multiple times but you are only eligible to win one (1) Prize only during the course of the competition.

Conditions of entry

This competition is an initiative of State Library Victoria, 328 Swanston Street, Melbourne, Vic, 3000 ('Library').

Entry into the competition means you accept these terms and conditions.

Entry into the Competition is free (except for any normal internet connection charges that may apply).

To enter and be awarded the prize, entrants must be Australian residents and 18 years and over.

Employees of State Library Victoria, Cricket Australia and its agencies associated with this promotion, and their immediate families, are not eligible to enter.

The judges' decision is final and no correspondence will be entered into. Only one winner will be notified.

No responsibility is accepted for any variation in the value of prizes.

No responsibility is accepted for late, lost or misdirected entries.

Any personal information entrants provide will be treated as confidential and managed in accordance with the State Library Victoria's Privacy statement.

State Library Victoria reserves the right to modify these terms and conditions at any time without notice.

State Library Victoria may disqualify you if:

i. you or your Entry do not meet any one or more of the requirements set out in these Terms and Conditions;
ii. your Entry includes any objectionable material or infringes the rights (including intellectual property rights) of any third party; or
iii. you tamper in any way with the operation of the Competition.

Your Entry must be complete, in English and legible.

Dates

The competition commences on 16 December, 2019 at 7am EST.

Entries close on 23 February, 2020 at 11.59pm EST.

Prize draw and notification

The Competition is a game of chance. Skill plays no part in determining the winner.

State Library Victoria will appoint judges for the Competition (the 'Judges').

The prize Selection Date will be drawn at State Library Victoria on 24 February, 2020.

The winner selection will take place on the Selection Date. The Judges will select from all valid Entries into the Competition, one (1) prize winner will be awarded as the Competition prize winner. The Judges' decisions are final and no correspondence will be entered into.

The winner will be notified by direct message on Instagram on the Selection date. All reasonable attempts will be made to contact the Winner. If, despite reasonable efforts by State Library Victoria a potential prize winner does not respond to State Library Victoria by 2 March 2020, 11.59pm EST, the prize(s) will be forfeited and State Library Victoria reserves the right to select a new winner.

If any proposed selection date falls on a public holiday in Victoria, that selection will be conducted on the following business day.

Prize

The prize is not transferable or exchangeable and cannot be taken as cash.

One (1) Major Prize winner will be drawn.

The prize includes:

  • An exclusive showing of State Library Victoria’s most treasured literary cricket items, hosted by a Librarian
  • A 2002/2003 signed Ashes replica Cricket Bat.

The maximum total prize pool value will not exceed $1,000.00 AUD.

The prize excludes all associated transfer costs, including: airfares, accommodation, taxi fares and transport.

The Major Prize is subject to the terms and conditions as imposed by the provider of the prize, including period of validity and expiry, or any booking or redemption time frames.

If the prize is unavailable, for whatever reason, State Library Victoria reserves the right to substitute the prize for a prize of equal or greater value, subject to law.

You may not transfer the Prize to anyone or ask for any alternative Prize (including cash).

If you are not able to take the Prize as stated, you will forfeit the Prize and no payment or compensation will be made in lieu.

State Library Victoria may ask you or your parent/legal guardian to provide proof of your age, identity and residency, and to sign any required documentation including release forms as a condition of claiming the Prize.

You or your parent/legal guardian are responsible for all expenses and taxes connected to your participation in the Competition and not included in the Prize.

The exclusive showing of State Library Victoria’s most treasured literary cricket items must be claimed and completed within 6 months of the competition, by 1 September 2020. The signed cricket bat will be awarded during this tour at State Library Victoria.

Ownership

State Library Victoria (and its agents) collect, hold, and use the personal information of entrants for the purpose of conducting this competition, and for future promotion of State Library Victoria's goods and services in accordance with the State Library Victoria's Privacy Policy.

You agree that all of the rights (including intellectual property rights) in your Entry, including any copyright works in your Entry, belong to State Library Victoria and you hereby assign any rights you may have to State Library Victoria. This includes all copyright (present or future), other intellectual property rights and rights of ownership. You grant a perpetual worldwide license (including a right to sub-license) to State Library Victoria of all rights in your Entry pending completion of this assignment.

You agree to do all things necessary (which may include signing documents) to transfer these rights to State Library Victoria.

You consent to State Library Victoria doing or omitting to do anything that infringes your moral rights in your Entry. Moral rights are your inherent rights in your Entry as the author and/or performer in the Entry and comprise the rights:

i. to be attributed as the author of the Entry;
ii. not to have your authorship of the Entry falsely attributed; and
iii. of integrity of authorship and/or performance.

You may keep any copy of your Entry for your personal records.

Other Terms

The Winner hereby grants to State Library Victoria the right to issue, and authorise others to issue, publicity concerning the Winner, and the right to use Winner's name (including any professional name or sobriquet adopted by Winner), likeness and biographical data in connection with the promotion of the Competition.

State Library Victoria and agencies or companies associated with this Promotion will not be liable for any loss or damage whatsoever which is suffered (including indirect or consequential loss) or for any personal injury suffered or sustained in connection with a prize except for any liability which cannot be excluded by law.

State Library Victoria and their associated agencies and companies is not liable for (including any costs) any error, omission, interruption, deletion, defect, delay in operation or transmission, network failures, tampering, unauthorised intervention, fraud communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and any cause beyond the control of State Library Victoria, and reserves the right to take any action that may be available.

In the case of the intervention of any outside act, agent or event which prevents or significantly hinders State Library Victoria's ability to properly proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, computer virus, fraud, tampering, unauthorised intervention, or technical failure, State Library Victoria may in its absolute discretion cancel, terminate, modify or suspend the competition, subject to direction of the relevant authorities.

State Library Victoria may disclose entrants' personal information to companies connected with this Promotion and to State/Territory authorities. If the entrant does not agree with the collection, use, holding or disclosure of their personal information, they must not enter this competition. If the entrant no longer consents to their details being used, or wish to update, modify or delete their details, the entrant should contact State Library Victoria.

The Competition and Consumer Act 2010 (Cth) as well as other laws in Australia may imply certain conditions, warranties and undertakings, and give you other legal rights. If they apply, they cannot be modified or excluded by any contract. You may consider seeking legal advice as to whether they apply to you.

Nothing in these Terms and Conditions generally affects your rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law. Other than these consumer guarantees, and subject to paragraph 7b, State Library Victoria makes no warranties about any prizes offered as a part of the Competition, including warranties as to the quality, merchantability or fitness for purpose of such prizes.

You agree to indemnify State Library Victoria against all liabilities suffered or sustained by State Library Victoria arising from any claim by a third party that your Entry infringes the rights (including intellectual property rights) of any third party.

Severability

Any provision (or part thereof) of these Terms and Conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions (or parts thereof) of these Terms and Conditions nor affect the validity or enforceability of that provision (or part thereof) in any other jurisdiction.

Entire Agreement

These Terms and Conditions contain the entire agreement between you and State Library Victoria with respect to the Competition. They set out the only conduct that you have relied on and supersede all earlier conduct and prior agreements and understandings between you and State Library Victoria in connection with the Competition.
