This statement outlines the principles that guide the State Library of Victoria in relation to collecting, handling and storing your personal information and your responsibilities when using personal information contained in the Library's collections.
Privacy of your personal information
When collecting and managing your personal information the Library complies with the ten Information Privacy Principles contained in the Victorian Information Privacy Act 2000 and where applicable the Health Records Act 2001.
Principle 1 - Collection
The Library only collects your personal information from you when reasonable and when it is necessary for its functions or activities. The Library will collect your personal information in a fair and reasonable manner and will take reasonable steps to tell you who we are, how to contact us and the reason for collecting the information.
Principle 2 - Use and Disclosure
The Library does not use or disclose personal information about you unless you have consented to the use or disclosure or except in exceptional circumstances where authorised by law.
Principle 3 - Data Quality
The Library takes reasonable steps to make sure that the personal information it collects, uses or discloses about you is accurate, complete and up to date.
Principle 4 - Data Security
The Library takes reasonable steps to protect your personal information from misuse and loss and from unauthorised access, modification or disclosure. The Library takes reasonable steps to destroy or permanently de-identify your personal information when it is no longer needed.
Principle 5 - Openness
The Library privacy policy is available to anyone. On request the Library takes reasonable steps to let you know, generally, what sort of personal information it holds, for what purposes, and how it collects, holds, uses and discloses that information.
Principle 6 - Access and Correction
The Library will provide you with access to the information it holds except in occasional circumstances as contained within the Information Privacy Principles. If the Library holds personal information that you think is not accurate, complete and up to date, the Library will take reasonable steps to correct the information.
If you and the Library disagree about whether your personal information is accurate, complete and up to date, you may ask the Library to associate a statement claiming so with the information.
In some circumstances the Library may refuse disclosure of the information held. In this circumstance the Library will provide you with the reason(s) for this within 45 days.
Principle 7 - Unique Identifiers
The Library will only assign unique identifiers to you, or ask you to provide a unique identifier, when this is necessary to enable the Library to carry out any of its functions efficiently.
Principle 8 - Anonymity
Wherever it is lawful and practicable, you can have the option of not identifying yourself when entering a transaction with the Library.
Principle 9 - Transborder Data Flows
If the Library transfers your personal information outside Victoria, we will comply with any applicable requirements of the Information Privacy Act 2000 and Health Records Act 2001 that relate to transborder data flows.
Principle 10 - Sensitive Information
The Library will not collect sensitive information without your consent or where the collection is required for legal reasons.
Privacy and your use of the Library collection
If you access other people’s personal information in the Library collection when undertaking your research or study, or for exhibition purposes, you are obliged to treat that personal information in the same way as we treat yours, as outlined above in the ten Information Privacy Principles.
Complaints
If you have concerns that the Library may have infringed your privacy rights you have the right to make a complaint to the Library, the Victorian Privacy Commissioner or the Health Services Commissioner (for Health Records).
